Ethics for Estate Planning Professionals

Ethical issues confronting estate planning professionals are often addressed in the principles of conduct governing the various professional disciplines whose members consider themselves as estate planning professionals. Who are the professionals involved and what ethical situations must they deal with in their daily work? How are their interactions with clients and each other regulated and for what reasons? Drawing from the actual codes of professional ethics, this presentation will present and examine the "Five C's" of ethics for estate planning professionals, which are: Competence, Compliance, Compensation, Confidentiality, and Conflicts of interst/disclosure. The materials presented and the information discussed are meant to serve as resources for estate planning professionals to better serve their clients and to be aware of relevant ethical issues facing other professionals involved with estate planning.

Presenter: Andrew M. Wilusz, ASA

Mr. Wilusz is the Director of Mergers & Acquisitions at Value Management Inc., a financial consulting firm headquartered in Jamison, PA that provides investment banking and business valuation services.  VMI's investment banking services focus on selling businesses in the lower middle market (under $100 million in value), identifying acquisition targets, and providing strategic M&A consulting services.  VMI sells and values privately-owned businesses, corporate securities, and professional practices.  Mr. Wilusz has been active in the appraisal profession since 1991 and has been Director of Merger & Acquisitions since 1995.  He has valued or assisted in the valuation of over one thousand businesses and has worked on nearly 100 transactions, with experience in a myriad of industries.  Currently, as the Director of Mergers & Acquisitions, he leads VMI’s investment banking division, serving as a transaction intermediary, initiating and negotiating the purchase and sale of privately held companies.  Mr. Wilusz is a member and past president of the Philadelphia Estate Planning Council and also of the Montgomery County Estate Planning Council.  He is also a member of the ESOP Association and the Association for Corporate Growth
(ACG).  Mr. Wilusz has given numerous CE and CLE presentations on a variety of topics addressing: Mergers & Acquisitions, Business Valuations, and Ethics for Estate Planning Professionals.  Mr. Wilusz has presented to many professional organizations, including: the Bar Association of Lehigh Valley, the Bucks County Bar Association, the Bucks County Estate Planning Council, the Berks Count Estate Planning Council, the Burlington County Bar Association, the Chester County Estate Planning Council, the Estate Planning Council of Lehigh Valley, the Montgomery County Estate Planning Council, the Pennsylvania Bar Institute, the Philadelphia Estate Planning Council
(Brown Bag), and the York County Estate Planning Council.
