Attendees will learn why so many trusts are changing trust situs to favorable jurisdictions(such as Delaware) and the various methods to move trusts. The differences and risks between using non-judicial settlement agreements, mergers, decanting, administration powers in documents and court approval will be discussed. Will also discuss recent legislation in Delaware surrounding the new “Excluded Trustee” and decanting statutes. Discussion will include the potential roadblocks to moving trust and planning considerations around those roadblocks.”
